Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of jo.institute (the “Site”) and any related online services provided by Journey Orthopaedic Institute, LLC (“JOI,” “we,” “us,” “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2) Not Medical Advice / No Emergency Use

 

 

The Site provides general information only and is not medical advice. Content on the Site (including articles, videos, FAQs, downloads, and AI/chat content if enabled) is for informational and educational purposes and does not replace evaluation by a licensed clinician.

 

Do not use the Site for emergencies. If you believe you have a medical emergency, call 911 or go to the nearest emergency department.

 

 

3) No Doctor–Patient Relationship Created by Site Use

 

 

Using the Site, submitting a form, or receiving a response does not create a doctor–patient relationship. A doctor–patient relationship is established only after JOI confirms acceptance of you as a patient and the appropriate consent and intake processes are completed.

 

 

4) Telehealth / Location Limits

 

 

If JOI offers telehealth services, availability depends on clinician licensure and applicable state laws. You are responsible for providing accurate location information at the time of service. JOI may decline or stop services if you are located in a jurisdiction where the clinician is not licensed or where telehealth is not permitted for your needs.

 

 

5) Appointments, Scheduling, and Communications

 

 

If you request an appointment or contact JOI through the Site:

 

  • You agree to provide accurate, complete information.

  • You authorize JOI to contact you by email, phone, and/or text regarding scheduling, administrative matters, and service-related communications.

  • Appointment confirmations and reminders may be delivered via automated systems.

 

 

Cancellations / No-Shows: Your appointment changes are governed by our Refund Policy and any posted scheduling rules (including cancellation windows and no-show fees).

 

 

6) Payments, Purchases, and Subscriptions (If Applicable)

 

 

The Site may allow you to purchase services, packages, memberships, subscriptions, or products.

 

  • Prices are shown in U.S. dollars unless stated otherwise.

  • You agree to pay all charges associated with your purchase, including applicable taxes.

  • Payments are typically processed by third-party payment processors; JOI does not typically store full card numbers.

 

 

Refunds: Purchases are governed by our posted Refund Policy (incorporated by reference).

 

Subscriptions (if offered): Unless stated otherwise, subscriptions renew automatically until canceled. You are responsible for canceling before renewal to avoid future charges.

 

 

7) Patient Forms and Intake

 

 

If you submit forms through the Site, you represent that the information is accurate and you have the right to provide it. Do not submit sensitive information you do not want transmitted online. If JOI uses a separate EMR/patient portal, that system may have additional terms.

 

 

8) AI Chat / AI Phone (If Enabled)

 

 

If the Site offers an AI chat widget or AI phone agent:

 

  • AI tools may generate responses automatically and may be incorrect or incomplete.

  • AI outputs are not medical advice and are not a substitute for evaluation by a licensed clinician.

  • Do not rely on AI for emergencies.

  • Your interactions (including voice recordings/transcripts, if enabled) may be processed for quality, safety, and operational purposes as described in our Privacy Policy.

 

 

 

9) Acceptable Use

 

 

You agree not to:

 

  • Use the Site in any way that violates applicable laws or regulations

  • Attempt to gain unauthorized access to the Site or its systems

  • Interfere with the Site’s security or operation (e.g., hacking, scraping at abusive volumes, introducing malware)

  • Submit false, misleading, or impersonating information

  • Use the Site to transmit unlawful, harassing, defamatory, or abusive content

 

 

We may suspend or terminate access to the Site for violations.

 

 

10) Intellectual Property

 

 

The Site and its content (text, graphics, logos, videos, downloads, and design) are owned by JOI or its licensors and are protected by intellectual property laws.

 

You may view and use the Site for personal, non-commercial use only. You may not copy, reproduce, distribute, create derivative works, publicly display, or exploit Site content without JOI’s written permission.

 

Trademarks: “Journey Orthopaedic Institute,” “JOI,” and related logos/marks are JOI trademarks or service marks. Unauthorized use is prohibited.

 

 

11) User Submissions (If Applicable)

 

 

If you submit reviews, comments, testimonials, photos, or other content (“User Content”):

 

  • You grant JOI a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that User Content for business purposes (e.g., marketing), unless prohibited by law or agreed otherwise in writing.

  • You represent you own or have rights to submit the User Content and it does not violate any third-party rights.

 

 

We may remove User Content at our discretion.

 

 

12) Third-Party Services and Links

 

 

The Site may link to or integrate third-party services (e.g., scheduling, payment processors, analytics, social platforms). JOI does not control and is not responsible for third-party sites, services, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

 

 

13) Privacy

 

 

Your use of the Site is also governed by our Privacy Policy (incorporated by reference). If you become a patient, you may also receive a separate Notice of Privacy Practices when applicable.

 

 

14) Disclaimers

 

 

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

 

  • JOI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • JOI DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT CONTENT IS COMPLETE OR ACCURATE.

 

 

 

15) Limitation of Liability

 

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

 

IN NO EVENT WILL JOI’S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID JOI THROUGH THE SITE IN THE [3] MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

 

(Some states do not allow certain limitations, so parts of this section may not apply to you.)

 

 

16) Indemnification

 

 

You agree to indemnify and hold harmless JOI and its affiliates, officers, employees, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

 

 

17) Termination

 

 

We may suspend or terminate your access to the Site at any time for any reason, including suspected violations of these Terms, security concerns, or operational needs.

 

 

18) Changes to These Terms

 

 

We may update these Terms from time to time. Changes are effective when posted with a revised “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms.

 

 

19) Governing Law and Venue

 

 

These Terms are governed by the laws of the State of [South Carolina], without regard to conflict-of-law principles. Any dispute arising from these Terms or Site use will be brought in the state or federal courts located in [County], [State], and you consent to jurisdiction and venue there.

 

 

20) Miscellaneous

 

 

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement regarding Site use.

  • No Waiver: Failure to enforce a provision is not a waiver.

  • Assignment: You may not assign your rights under these Terms without JOI’s written consent; JOI may assign freely.
